New DTI Planned Franchisor Guidelines

The Department of trade and industry (DTI) has announced that they will be setting and implementing new guidelines that will regulate the franchise industry and protect the public from franchise scams that is becoming very common these days. The DTI has proposed to a cap on the number of years a company should be operating before that can offer themselves up for franchise. Wouldn’t you be more interested in a business that has already a proven track record?

But 2 big franchise organizations in the Philippines, namely Philippine Franchise Association (PFA) and the Association of Filipino Franchisers Inc (AFFI) have opposed such regulation in the industry which has baffled me but not surprising since they have vested interest in this.

The current franchise industry is pretty much self-regulated, which in my opinion has not worked out too well. It’s close to being the wild wild west. Many franchise companies, some are even MLM companies cleverly disguised as offering legitimate franchises are popping up at an alarming frequency often offering substandard franchises that’s ruining the industry as a whole. The year 2009 has been a stellar year for the franchise industry. With record entrepreneurs going with a franchise to start their business, we can only expect 2010 to even be better. But what can we expect 2010 to bring? Well here are some of my mini predictions on where the franchise industry is headed plus a great brand to franchise if you are looking to start your business next year. These are just my personal opinions and should not be treated as the gospel truth.

The food industry will still remain very strong, if not stronger. Like 2009 was, 2010 will be a great year to start your very own food business.
More companies will open up their business for franchise.
There will be more franchise expo, including international brands that will be available for us next year.
One brand to look out for is Mang Inasal. With their ever expanding branches nationwide (I have been all over the Philippines this year and they are EVERYWHERE!) and planned IPO next year, the current cost of franchising them at the present is considered a good bargain.

The financial world has been rocked in the past few days due to the bankruptcy of the 158 year old company Lehman Brothers, ending with a total debt of $613 billion. Their demise has sent shock waves to the global financial market and has sent stock markets all across the region tumbling down. While there is no doubt that the stock prices will recover again given due time, the bigger question is what effect does this have on the Philippine financial banking institutions?

The good news is that most of the banks exposed to Lehman’s are the big banks, like Metrobank, RCBC and BDO who can easily survive this exposure and by immediately coming out and declaring how much of their funds are exposed to Lehman’s, they have prevented unwarranted speculations that may lead to fear and panic among our local bank’s depositors. But it does not look good for their bottom line despite the press release that this will have minimal effect on their income. I work in a bank and trust me, it’s actually worse than what their PR folks are trying to paint. But their depositors should not worry about anything despite the billions of pesos of the banks money exposed to Lehman’s because they have sufficient cash to absorb this loss and remember that these exposures are not 100% uncollectable. They will still get something but at a heavily discounted rate.

3.) This may sound mean, but it's practical. If you don't think your family will use the money you sent home wisely. Open 2 savings account and don't tell anyone about your other account then remit part of your earnings there. Philippine Credit Card Scams

I was just recently a victim of a new modus operandi of credit card scammers. Anyone who's applying credit cards over the phone should be very careful in giving out their personal information or just abandon that practice although out. A shady credit card agent gave me an unsolicited call in the office offered to give me a Unionbank gold credit card wherein I don't have to submit any documents to them and will just conduct my interview over the phone. Having acquired some of my credit cards that way, I naively gave my personal information as well as the information of my existing Citibank credit card number, join date and expiry date. The agent also instructed me to fax my latest ITR as well as the credit card statement of my existing card. Finding no deviation from the SOP of what credit card agents normally require for an application, I also faxed those documents.

A week later, I was surprised to receive a credit card from the courier for my existing Citibank credit card that has my name but bears a different address. Alarmed, I immediately called up Citibank and ask why was a card delivered to me when I did not request for any replacement. Turns out there was someone who called claimed to be me reported that my Citibank credit card had been lost and requested a reissue, he also changed my billing address where the credit card was supposed to be delivered. Luckily, the billing address he has given was incomplete and the courier delivered the card to my office address which thankfully the fraudsters did not change. I immediately blocked my card and reverted the changes made to my billing information and I plan to close my credit card with Citibank because my credit card as well as my personal information was already compromised.

I find it VERY surprising how easily it is for the fraudsters to change my billing address. These credit card companies should be stricter in changing sensitive personal information like that through a more thorough verification process like needing to fax a proof of billing for the new address or immediately call back the card holder to verify if they indeed changed their address through the contact numbers originally provided, since I highly doubt these scammers would give out their own landline. I am planning to file this report to the NBI to hopefully catch this syndicate and prevent anyone from becoming victims of this scam. Please do not give out your personal information over the phone and if they claim to be from your credit card company, get their name and phone number or local extension and tell them you will call them back as soon as you verify with your credit card company that the name and contatc number the person who just called you are indeed connected to their company.

I have just finished reading the book of Francisco J. Colayco Wealth Within Your Reach and Making Your Money Work. I enjoyed the books very much and I recommend it to anyone who has not read this book yet to go to your favorite book store and get a copy, it's a great way to learn financial literacy. These days, although Christmas is no longer celebrated as long as it’s used to due to economics reasons, the Philippines is still one of the countries that celebrates Christmas day the longest. This long anticipation gives rise to deceitful businessmen taking advantage of the shopping rush, selling inferior goods for a very low price or bogus offers to unwary consumers. These substandard products are not only cheating the consumers out of their hard earned money but will cause dangers to life and property like poor quality Christmas lights have been known cause fires and deaths. The Department of Trade and Industry (DTI) is aware of such dishonest acts, as it has been clamping down on unscrupulous businessmen who are selling shoddy products. Consumers likewise must also be aware of their rights.

The DTI is designated to regulate business establishments to ensure that they deal with consumers fairly and reasonably. This gvernment body can impose an administrative fines ranging from 500 pesos to 300,000 pesos among other sanctions, to those who are caught and proven guilty of committing deceptive sales act. But I would like for them to impose even harsher penalties to deter these fly by night businessmen. Based on my observation, there are two kinds of poor people who want to get rich. People who expect to get rich instantly while doing as little work as possible expecting to win the lottery or depend on the government to be somehow the answer to their prayers by providing them with dole outs of not only food but also money and a house and lot while holding their heads up high as if the state owes them anything. On the other side are people who came to realize and accept the fact that they are poor but are determined to find a way out of destitution by sheer hard work, creativity and ingenuity.

We must realize money does not fall down from heaven; you have to work hard to earn it. Individuals who have experienced poverty before are wiser in making monetary decisions; they treat money as a limited resource not just something that can be spent on a whim without thoroughly thinking it through. But what are the things we need to look for when choosing for the right bank? Here are the top three criteria I look for in choosing a bank for my franchise business.

1.) Accessibility and Geography - I consider this the most important criteria for me when choosing a bank. A bank can have the longest banking hours and the lowest maintaining balance or even the friendliest staff, but if they are located very far from where you live or do your business then especially if you have to go there everyday, all of the other criteria goes out the window.

Maintaining Balance and Penalties- Depending on the size and scale of your franchise business operations, the amount of money you need to maintain an account without falling below the required maintaining balance is important. Depositors who fall below the minimum maintaining balance of their accounts are penalized between 100 to 200 pesos per month, That is more money than you will ever get from the interest of your savings account in a year. Some businessmen complain about the charges and claim they were never informed about them. But the banks terms and conditions in regards to penalties and other matters of concern are clearly indicated in the documents we are required to sign up upon opening of the account so we have no legal right to complain. Make it a habit to read all their terms and conditions prior to signing because once we sign, we are agreeing to their conditions. If you find their terms unacceptable then simply look for another bank whose conditions you are more comfortable with.
